A few suspicious things I am seeing here right off the bat:
- She doesn't mention where exactly they are. They are just somewhere in LA.
- She doesn't describe "the incident". This makes it sound like it was from the finger. Actually, Johnny broke his wrist.
- She doesn't give a date for this. Just "March".
So...are they in the penthouse? Let's go with yes. As you read the first like...three sentences, notice that she goes from "still in a cast following the incident in Australia" to "After becoming enraged"...why was he enraged? Did a niffler break in and steal all of his valuables? Did he lose a bet? Is he having trouble sneezing? Is he constipated? Unfortunately, we'll never know because Amber doesn't tell us. She doesn't mention where in the condo they are, what they were doing, what they were saying. Nope. Just that Johnny got enraged.
He starts to destroy personal property all over the...oh I see, the "house"...with a broken wrist? And yet again, she doesn't mention any drug or alcohol use...so Johnny is destroying a bunch of shit while SOBER with a broken wrist that is in a cast...for seemingly no reason. Right. JOHNNY SMASH.
After Johnny finishes destroying personal property all over the house...notice that Amber doesn't specify which "personal property" he destroys...oh wait, she does, the stuff in the closet. She fails to mention that her "closet" is almost the entirety of Penthouse 5.
Ok. So this next bit is confusing BECAUSE Amber failed to mention up until this point where in the condo they were. Johnny and her are apparently by some stairs. Let's turn our attention to her deposition excerpt she has attached to get a more clear picture of this.
We learn that apparently all three of them are standing on a landing in between two flights of stairs. She also, for some reason, fails to mention half of this event in her declaration. Jerry and Sean were there in the deposition...but not there in the declaration? Johnny also didn't hit her in the declaration, but he did a lot in the deposition...
Anyway, let's go back. They are on a landing between two flights of stairs. Presumably, Amber and Johnny are like this:

And then Whitney sees Johnny "lunge" to hit Amber, and jumps in between them. Amber doesn't describe what Johnny actually "does" to Whitney, just that he "moves on her". Then Amber jumps back in between Whitney and Johnny and punches Johnny in the face. In the deposition, however, she can't remember exactly what she did. She says "she doesn't know what part of her body"...but it sounds like she put her whole body there...and then in the declaration she outright states that she punched him.
She also says that "she saw" her sister standing at the top of a flight of stairs...as though she had just freshly entered the situation...but she was already there.
Also notice how much she says without actually saying a whole lot of anything. She could have said "Johnny was being aggressive towards my sister so I defended her." Then Berk could have asked more questions.
But her description of this incident goes on for two whole pages.
A COUNTER. Let's see how many times she says certain things.

Remember how Blair Berk was trying to get her to respond to yes or no questions? This is why. Because a liar will ALWAYS use as many words as possible to embellish, deviate, or manipulate the truth and their story. Giving them yes or no questions makes it very hard for them to have any chance to do that.
She does a lot of explaining about WHY she wanted to defend her sister, and WHY her sister deserved to be defended...when that is pretty irrelevant in this case. The reason she does this is because she wants to implant a sense of sympathy into their heads. "My baby sister was being attacked so OF COURSE I needed to defend her as a good sister. My baby sister HAS NEVER hurt anyone ever..."

These are the text messages that were sent by Whitney Heard to Kevin, the house manager.
I have a few questions.
First, why were they in Penthouse 5 to begin with? Why would Johnny go in there? Him and Amber live in Penthouse 3. Being that Amber didn't describe WHY Johnny got angry, we don't know.
Keep in mind Amber is suggesting that Johnny did all of that with a broken wrist. While sober.
Also, can I just mention something? From how she describes it, it sounds like she thought Johnny meant to kill Whitney.
Why, exactly, would you STAY with someone who had tried to kill your sibling? FOR ANOTHER WHOLE ASS YEAR.
That does not make ANY sense. At all. And if I stayed with someone who tried to push my sister down the stairs, I would fully expect my sister to never speak to me again. ???????????????????????????????????????????????
Then Amber says that after this attack on her and her sister, Johnny stopped drinking and using drugs.
She gives absolutely NO reason for this. He just suddenly stopped. There was no discussion, no intervention, nothing. Was it because of the sister thing? Why doesn't she have any evidence to support why he suddenly got clean? She sure was interested in talking about how much he was doing drugs before.
Then she mentions that "some months later" (three months), he started to drink wine and smoke weed again.
OH NO, LOOK OUT, SOMEONE IS DRINKING WINE AND SMOKING WEED.
Since when has weed ever made ANYONE violent? It just makes you have the munchies and want to sleep.
So now we are in August, during their honeymoon. She says that while on the train, Johnny decided to "pick a fight" with her. Unless she is carrying over the weed and wine from the last item...he is evidently sober here too. So what was he picking a fight with her about?
She says that he started hitting her and pushing her against a wall by grasping her throat. She says she was afraid that Johnny might not know when to stop, resulting in her death.
On a moving train. A luxury moving train. While sober. For seemingly no reason.
Right.
The inside of the train looks like this. She doesn't specify where in the train they were (a private room, maybe) so I am forced to assume they were out in the open.
Why didn't any of the other passengers see or hear anything? Even if they were in a private room, someone would have heard something. So why doesn't she have any witnesses from this event?
And looking at this picture...where is the wall that Johnny was supposedly slamming her against? All I see are windows and curtains. I do see that wall sort of thing in the right of the picture, but that looks like a hallway to me, so.....
Once again, her story doesn't have the crucial details to make it make sense.
This is a picture of them on the train. I am not sure how far into the trip this was, or when it could correlate with the story she told.
Zoom into his face. I don't know about you, but it looks like someone punched him. His eye looks a little swollen and bruised, and look how smug she looks.
Many many instances where she claims she was abused, he is the one that actually looks injured.
I feel safe in stating, at this point, that she is fabricating these stories of hers from the times that SHE abused HIM. The train incident is just one of many.
A narcissistic abuser would take great pleasure in forcing her victim to stand in the presence of others bearing the marks of her abuse on him, especially when others choose to do nothing about it.
These are photos of him taken on July 24th. He looks very high and drunk to me. (Not.)
Moving on to the next bit, we are now in November. Let's go a little before Thanksgiving, on November 21st. The premiere of the Danish Girl. I realize that since this is before the alleged incident occurred, she wouldn't have any bruises on her. I chose to showcase these photos to showcase the dynamic between them.
I am keeping this one big on purpose. Look at her facial expression. Now, you could say that it was just her face at the time, and the camera happened to capture it.
But if you actually look at it, at her face, you can SEE the control in her eyes that she has over him.
This is a classic open reminder that she is giving him that he has to submit to her.
Anyway, back to the actual incident. Notice that, again, she doesn't give any indication that he has used any drugs or consumed any alcohol, even though the entire basis for his abuse stems from his alcohol and drug use. She also doesn't give any indication of where they are, besides Los Angeles. According to her, Johnny "ripped her shirt" and "threw her around the room". Hm. He then threw a wine glass and a decanter at her. And then "at one point", Johnny "shoved her" and she fell over a lounge chair and "hit her head on a brick"....
...wall, and later "learned" that she had a sizable lump on her head and a busted lip.
Let's talk about the lounge chair and the brick wall. Like I said, she doesn't specify where they are, but I am going to ASSUME they are somewhere in the Eastern Columbia Building. It sounds like they could be at the pool. Also note that she has NO attached evidence of this incident. She didn't take any pictures of her lip, and she didn't see the doctor for her head. I am also finding it a little difficult to imagine being shoved in such a way that I would fall over the back of a lounge chair.
Oooook, so now we arrive at what she has always claimed to be the "horrific" incident of abuse. She says that Johnny "picked a fight with her" (again) for no reason, and threw another decanter at her. Presumably he is sober again for this incident, as she mentions no drug or alcohol use here.
He "knocked" items around the room, and punched the wall. He then "slapped her hard", grabbed her by the hair and "dragged me from a stairwell, to the office, to the living room, to the kitchen, to the bedroom, and then to the guest room".
Let's go through that last bit again. He dragged her "from a stairwell, to an office, to a living room, to a kitchen, to the bedroom, to the guest room".
That is six places.
SIX.
Then she says that "hoping to avoid the violence"...but wait, was this after he had dragged her through six rooms? If so, there has already BEEN violence...or was this supposed to be stated before the dragging?
She tried to calm Johnny down, which evidently failed, so she went upstairs to "remove herself from the situation". Johnny followed her, hit her on the back of the head, and grabbed her by...ah, she says "again". So that means that she really was hoping to avoid the violence AFTER he had already dragged her through six rooms. Apparently.
He then drags her up some more steps by the hair (this is after massive chunks of her hair have been pulled out, by the way) and shoves her...and then she didn't fall. She also tells him that he has broken her wrist. (As if an abuser would stop because of that.)
Ok, I have some more questions. How did she try to "calm him down"? She doesn't specify that. How did she manage to get out of his grasp when he was dragging her around the condo? And...he grabbed her by the hair, then let go, then grabbed her by the hair again?
Let's also take a moment to talk about how this condo is laid out.
The living room, kitchen, and guest bedroom are on the first floor. The office and the master bedroom are on the second floor.
So, according to her, he goes from a stairwell to the office (2nd floor), to the living room (1st floor), to the kitchen (1st floor), to the master bedroom (2nd floor), and then to the guest room (1st floor).
Now she describes that he "keeps hitting her" and "knocking her down"...so does she get back up each time? Then she chooses to react by standing up and looking him in the eye. Yeah, that sounds like a normal victim thing to do.
Then he head butts her in the face...bashing her in the nose, which immediately began to bleed. She "thought" she would have to go to the hospital.
She tells Johnny that she wants to leave him, and she would call the police if he ever touches her again. She walks away to the guest apartment (room? condo?) and he responded by pushing her, and...
Wait. He is dragging her by the hair again. Didn't he already do that? Is he doing it again? Is it the same incident as before?
She says (again, and presumably while he still has her by the hair, because the office was the first room he dragged her to) that she will leave him because she can't stand his behavior anymore. Johnny reacted by grabbing her by the throat, pushing her down, and punching her in the back of the head.
He then grabbed her by the hair (again) slapped her in the face...let's do a quick counter, starting at item 23.
Slapped: 4 (I am going to count the beginning of 25 as two slaps.)
Grabber her by the hair: 5
Punched: 4 (I am also going to add two punches from the beginning of 25.)
Shoved: 4
Headbutt: 1
The reason I wanted to bring all of this up was because of her appearance only two days after what was apparently the most horrific incident of abuse she experienced.
This was her on the James Corden show two nights later, December 17th.
I am really struggling to see any sign of abuse here. There is no swelling in her face, her lips are fine, her hair is fine...she looks fine.
Yeah, super abused.
Oh shit, evidently we have more to this incident. So keep in mind that in the pictures above, she didn't even look like the previous shit had happened. So now let's see what else is supposed to be apparent in the James Corden appearance.
"At some point" the fight continued on a bed. Which bed? The guest bed? The master bed?
She says that Johnny got on top of her with his knee in her back (so she must have been face down), while punching her in her head. The bedframe splintered under the weight of his boot...but I thought he was on top of her? Does he have an extendable leg now?
She says she was unable to hear herself screaming...but even if her face was pushed into the mattress, she would still have been able to hear herself screaming.
Then she says that "for awhile, she couldn't scream or breathe". So was she ever screaming?
Then, she says that "to this day" she "doesn't know how the fight ended". So she knows every single detail up until this point, but does not know how the fight ended. Let's look at her evidence.
So this is the bed frame that she claims Johnny splintered. But if you go back and read, she says he was on top of her at the same time. Also, where is the mattress? And where is the rest of the bed? If this is a bed in their condo, it is probably at least a full size bed. This looks like a twin. Where are the sheets? Is this even a bed? And which side of the "bed" is it?
This is the picture of her hair. "Hair" from her head. But...her hair wasn't this color at the time. This is like a platinum blonde. However, I do see that the hand (which is there for no reason) is also rather white. They might have used a flash. Also, this does not look like hair that was pulled out by the root.
Evidently Rocky and Melanie came in afterwards. They called a nurse (who is strangely not a witness) about how to conduct a concussion check. She says she had severe pain and headaches over the next week.
She says she "later learned" that when Raquel and Melanie arrived, broken glass and chunks of hair were "strewn" across the downstairs of the penthouse.
And then she says she has some pictures of her injuries, and a picture of some gold sharpie (when the fuck did that happen?)...
She goes on to say that she texted her publicist Jodi Gottlieb, to tell her that she had been badly injured and may not be able to make it to the Late Show (pictured above)...
So let's take a look at her "injuries" that she claims made her unable to attend the Late Show.

No, no it's not.
She was going to be so bruised and battered and blah blah that she wasn't sure if she could make it to the Late Show, but the photos she took do not show her even close to being bruised and battered enough to not be able to make it to the Late Show.
Jumping off the video and photos FROM the Late Show, let's take a look at a few photographs of her at the island. Because her and Johnny went to the island from December 27th to December 31st - for Christmas.

Below are some examples of what a few of her injuries SHOULD look like.
A day or two later (she doesn't remember how long after this horrific episode she went to the doctor) she went to Dr. Kipper's office. Evidently, she saw a nurse named Lisa Beane, who told her that if she was attacked again, she could call.
But this is a problem because health practitioners in CA are required BY LAW to report any domestic violence injuries they treat to the LAPD. See below.
Before I talk about what she says here, I will briefly summarize Johnny's version of the story.
He arrived late from a business meeting, and Amber didn't like that, so she grew irritated. When he retreated upstairs, she followed him and punched him twice in the face while he was reading a book. He left after that.
Ok, so according to Amber, Johnny arrived late and was already drunk. After the guests left, they started to fight. Johnny threw a magnum sized bottle of champagne against the wall. He then pushed her onto the bed. Then he grabbed her by the hair and shoved her to the floor.
Johnny and her did not speak for an entire month following this incident.
I am not going to comment on her deposition transcript because I do not care about it. I will be commenting on the videos in another section of the website.
